Abstract

This article examines the legal nature of the National Difal Portal and its relationship with the enforceability of the ICMS differential rate (Difal) in interstate transactions involving final consumers who are not taxpayers. The study addresses the controversy regarding whether the enforceability of the tax depends on the full functionality of the portal established by Article 24-A of Complementary Law No. 87/1996. A doctrinal legal methodology is adopted, supported by an exploratory empirical analysis of the system and a review of state court case law. The findings indicate that the portal has an instrumental nature and does not constitute a condition for the enforceability of the tax. The study concludes that operational deficiencies do not invalidate the Difal, but rather highlight the need for institutional improvement in light of the principles of cooperation, simplicity, and transparency introduced by Constitutional Amendment No. 132/2023.
